Trueroots - Stretch Talk - Terms and conditions

The Trueroots-Stretch Talk Promotion ("Stretch Talk") is being offered by TATA Communications (America) Inc. ("Tata Communications").

Stretch Talk is available to all Prepaid customers who register for Stretch Talk and those Stretch Talk customers who recharge their accounts during the offer period - existing customers as of the date of launch of the offer and whose accounts are active, as well as new customers who register for the Stretch Talk during the offer period (existing Prepaid customers and new Prepaid customers are hereinafter collectively referred to as the "eligible subscribers").

On the plan with US$8 value, the subscription fee is $0.00, and is charged every time you buy/recharge this product. The subscription fee is deducted from the plan value ($8) and cannot be used to make any calls. The total $8 is the value of talk time for eligible subscribers to avail of highly discounted rate to India.
The Stretch Talk plan of $8 will have the validity of 15 days from the date of purchase of account/date of making the first call. The validity will be calculated on 24 hour basis (for example, if you sign up for Stretch Talk on 1 May 2009 at 3:00 p.m., your subscription will remain valid until 2:59 pm on 16 June 2009). Unless the subscriber recharges the Stretch Talk account to extend validity (as discussed below), any Talktime value left after expiry of validity will be automatically forfeited.
On the plan with US$10 value, the subscription fee is $0, and is charged. The subscription fee is charged every time you buy/recharge this product. This amount is deducted from the plan value ($10) and cannot be used to make any calls. The balance of $10 is the value of talk time for eligible subscribers to avail of highly discounted rate to India.
The Stretch Talk plan of $10 will have the validity of 30 days from the date of purchase of account/date of making the first call. The validity will be calculated on 24 hour basis (for example, if you sign up for Stretch Talk on 1 May 2009 at 3:00 p.m., your subscription will remain valid until 2:59 pm on 31 May 2009). Unless the subscriber recharges the Stretch Talk account to extend the subscription (as discussed below), any Talktime value left after expiry of validity will be automatically forfeited.
During the promotion period, you can extend the validity of previously purchased Stretch Talk minutes by recharging your Stretch Talk account. For example, if you have $2 of talk time left on your account, and you recharge the account before that $2 expires, the validity of that $2 will be extended through the entire recharge period. Note that you can recharge an $8 plan only with another $8 purchase; similarly, you can recharge a $10 plan only with another $10 purchase.
Stretch Talk is available to all eligible subscribers who register for the offer on or after 4:00PM Eastern Time on 19th Feb 2010 until Tata Communications, at its sole discretion, discontinues the Stretch Talk promotion.
Eligible subscribers are not allowed to purchase both Plans to run at the same time in one account.
The call charges ( to India ) would be calculated as follows:

For Local Access numbers:
First 5 minutes of each call: Calculated at 3.9c/min
> 5 minutes : Calculated at 1.5c/min
The 1.5c/min is applicable only to the incremental minutes from the 6th minute onwards.
For e.g. If a call is made for 8 minutes, then the call charges would be as follows : ( 5 X 3.9 + 3 X 1.5 = 24 cents )

For Toll Free numbers: First 5 minutes of each call: Calculated at 4.9c/min.
> 5 minutes : Calculated at 2.4c/min
The 2.4c/min is applicable only to the incremental minutes from the 6th minute onwards.
For e.g. If a call is made for 8 minutes, then the call charges would be as follows : ( 5 X 4.9 + 3 X2.4 = 31.7 cents )
Call charges to remaining countries (i.e., calls made to countries other than India) remain the same as provided in the trueroots website
Stretch Talk’s promotional rates described above are available only for calls originating from the U.S. Customers can use this product in UK and Canada. There would be no special rates however if this product is used in UK and Canada.
The customer can recharge his account by visiting the recharge page anytime while the offer remains valid. The product validity and the product talk time will be effective from the date of recharge.
Stretch Talk subscribers are bound by these terms and conditions as well as by the privacy policy and all other terms and conditions applicable to use of the trueroots service, available at http://www.trueroots.us. All incidental costs, taxes and levies related to the offer will be borne by the customer.
TATA Communications reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify the offer at its sole discretion as may be required by business requirements or governmental authorities and all such changes shall be binding on the eligible subscriber without any prior communication / notice.
The offer is neither assignable nor transferable under any circumstances. No substitution or refund nor exchange or redemption for an equivalent cash amount or any other benefit except what is provided as offer benefit shall be provided under any circumstances. This offer cannot be requested / combined with any other offer or promotion made by TATA Communications.
The claim/complaint/dispute regarding the offer should be made within 15 days of subscribing to the offer. No claim/complaint/dispute will be accepted and entertained in connection with the offer after 15 days of availing the same or the date of registration and TATA Communications shall not be held responsible for non-acceptance of the claim/complaint/dispute.
Once the eligible subscriber subscribes to Stretch Talk, the eligible subscriber shall not initiate any chargeback for the amount of recharge/payment, in case the same is done all the charges related to the chargeback will be borne exclusively by the eligible subscriber.
The decision of TATA Communications in regard to the offer shall be final and binding and is non-contestable.
This Agreement shall be governed by and construed in accordance with the laws of the United States of America. Each party irrevocably agrees to submit to the jurisdiction of the Courts of the Commonwealth of Virginia over any claim or matter arising under or in connection with this Agreement or the legal relationships established by this Agreement.
